According to the Basic Conditions of Employment Act, a refusal to pay salary is breach of contract. In a situation, where the employee earns below the income threshold a complaint can be lodged with the department of labour. Otherwise, the employee has a civil claim or can refer a dispute to the CCMA in terms of the BCEA.
