Can A Foreigner Claim UIF In South Africa

On December 18, 2017, the most recent revisions to South Africa’s Unemployment Insurance Contributions Act, 2002, were made official. Due to these changes, foreign nationals employed under a contract of employment in South Africa as well as their employers must start contributing to the Unemployment Insurance Fund as of 1 March 2018. (UIF).

These modifications under the Unemployment Insurance Contributions Act are effective as of March 1, 2018.
Rules for Making a Claim
If the worker had gone to South Africa to accomplish the following:

  • carrying out a service agreement;
    Inside South Africa, an apprenticeship or learnership;
  • When a contract was terminated, the employer was obligated by law or by the terms of the agreement to bring the employee back to South Africa.
  • UIF deductions for foreign employees, viewed through the lens of the employer.

How much Contribution is expected from Foreigners

Foreigners must now make mandatory deductions at a rate of 1% of their UIF compensation. The employee is expected to make monthly contributions, likewise at 1% of UIF compensation, both up to the existing cap

Employees must make contributions at the limited amount if their annual income exceeds R178 464, monthly income exceeds R14 872, and weekly earnings exceed R3 432.

Be aware that to comply with the new UIF contribution, firms who hire foreign nationals must update their payroll software.

Foreigners’ UI payment amounts Within South Africa

The maximum monthly donation is ZAR148.72 at the moment.where a foreign worker is paid by a local employer or where the worker’s wage is shown on a shadow payroll.The payroll system needs to be modified in South Africa to ensure that the UIF contribution obligations are met.

 

Can Foreigner apply for UIF in South Africa?

Employers must register foreign employees with the fund, and UIF is available to foreign nationals who are permanent employees. How does the fund benefit the workers? If they lose their jobs or are unable to work, employees who have paid contributions to the fund and are registered with the UIF are eligible to make a claim.

Who doesn’t qualify for UIF?

You can only receive the benefits if you made contributions to the UIF when you were employed. If you’ve quit, been put on administrative leave, or fled the office, you cannot make a claim. If the Commission for Conciliation, Mediation, and Arbitration (CCMA) believes that your claim merits A constructive dismissal is resignation.

If not used, does UIF expire?

In the event that you fail to claim your UIF funds, the Department of Labor will transfer them to an unclaimed benefit fund. However, if you choose to make a claim for your lapsed UIF benefits, you can still access your unclaimed cash by following the correct procedures.

What is the highest UIF payout allowed each month?

If you are paid monthly, for instance, multiply it by twelve and divide the result by 365. The UIF payout mechanism pays you according to the percentage of your salary that you earned while making contributions to it. 58% of what you make each day is the maximum that can be paid.

After ten years, can I file for UIF?

In the event that you have been paying the Fund  for periods of up to 238 days, you must have worked for four years or longer. For every six days that you worked while making contributions to the Fund, you can claim one day if you have been donating for a shorter amount of time.
