Customers of Cell C who intend to break their contracts early should be aware that the network levies an early termination fee.
A mobile network customer may terminate a fixed-term contract before the original expiration date in accordance with the Consumer Protection Act (CPA).
20 business days’ written or documented notice is required from the subscriber.
They will still be responsible for fees that had already become due and any unpaid money that was in arrears at the time of cancellation.
In addition, the supplier may impose a “reasonable” cancellation fee, but this is not required.
Mobile networks in South Africa use various methods to determine this sum.
The terms and conditions of Cell C’s 2021 Subscriber Agreement also mention an additional penalty fee in addition to the amounts previously mentioned.
The document states that the operator assesses a cancellation fee equal to the sum of 50% of the remaining contract term and the subscription costs.
The agreement was for a Samsung Galaxy A70 smartphone and a 24-month Pinnacle 2GB package.
A representative advised her that she would need to pay R1,550 for an early termination of the contract after she called Cell C’s cancellation department.
The monthly subscription and device fee was R429, making the balance due on the contract for the following three months R1,287.
The penalty fee would be equal to 50% of that sum, or R643.50.
The customer must also pay the device’s outstanding balance, which is R250 per month, as indicated by their monthly statements.
By the end of the month of the cancellation request, they had also racked up R99.98 in out-of-bundle usage.
Therefore, the cancellation fee should have been R1,493.48 rather than the amount quoted, or a difference of about R56.
