How To Withdraw A Case From Court In South Africa

You can petition the high court to withdraw the case if there is a legitimate reason, or you can go in court the next day and inform the judge that you don’t want to pursue the matter further and request permission to have it dismissed.

What steps are involved in withdrawing a case? 

If the complainant convinces the magistrate that he has adequate grounds to withdraw his complaint against the accused before a final decision is made, the magistrate may allow him to do so and will subsequently exonerate the accused.

Complainant can withdraw a criminal complaint filed in the court by appearing for the Court and making a statement that he/she wishes to withdraw the complaint. Withdrawing is a matter of right. Your statement will be recorded by the court and signed by you afterward.

In South Africa, can a complainant withdraw a case? 

The magistrate may permit the complainant to withdraw his complaint against the accused before a final decision is made if the complainant persuades the magistrate that he has sufficient grounds to do so.
