What is The Purpose of The HRC in South Africa?

The national organization created to support constitutional democracy in South Africa is the South African Human Rights Commission. It is dedicated to advancing the recognition, observance, and preservation of human rights for all without discrimination or fear.

History                                            

In accordance with the provisions of the Constitution of the Republic of South Africa Act 200 of 1993 and the Human Rights Commission Act 54 of 1994, the Commission was established on October 2, 1995. 2013 Human Rights Act

The Constitution, which is the supreme law of the land, was adopted in an effort to mend historical rifts and build a society founded on democratic principles, social justice, and basic human rights. These liberties are enumerated in Chapter 2 of the Constitution’s Bill of Rights.

The South African Human Rights Commission’s statutory authority

The South African Human Rights Commission is one of the entities established by the Constitution to aid in ensuring that the rights outlined in it are realized.

These independent organizations, sometimes known as Chapter 9 institutions8, have the broad responsibility of enhancing South Africa’s constitutional democracy. 9 They must be impartial, exercise their authority and carry out their duties without fear, favor, or bias. They are independent and are only bound by the law and the Constitution. 10 These organizations are answerable to the National Assembly, to whom they are required to provide at least one annual report outlining their operations and job performance. 11 These national human rights organizations, The Committee on Economic, Social, and Cultural Rights claims that these rights have a potentially crucial role to play in promoting and ensuring the indivisible nature and interdependence of all human rights. As a result, it is crucial that these rights receive full consideration in all of these institutions’ pertinent activities.

Authority of the SHRC

The Commission is authorized by law to look into and decide on claims of human rights violations against the Commonwealth and its agencies, including claims involving immigration detention. The Commission uses conciliation, a procedure, to try and settle grievances.

Relevance of HRC

The Commission is an independent statutory agency whose duties include investigating and resolving complaints of unlawful discrimination, creating awareness of human rights, reporting on concerns regarding human rights, conducting national investigations into cases of unlawful discrimination, etc.

How do they carry out their policy?

The NHRC is required to carry out the following tasks under the Protection of Human Rights Act: Investigate if the South African government has been intentionally violating human rights or whether a public employee has been negligently doing so. The defense of human rights and the suggestion of actions for their successful execution.
