What Is the Cost of Referring a Case to the CCMA?
The CCMA is an independent body that arbitrates labor disputes and offers guidance and training on labor relations. It is not a part of or governed by any political party, trade union, or company. Employees of all levels can file a FREE complaint against an employer who has treated them unfairly through this independently administered and sponsored organization. In fact, the CCMA handles more than 100,000 complaints involving unfair labor practices each year, in addition to the thousands of cases handled by the Labor Court, Labor Appeal Court, negotiating councils, and private arbitration forums.
How Can I Start the CCMA Process?
A referral form, also known as an LRA Form 7.11, can be completed in the first step and is accessible from the CCMA offices, Department of Labor, and CCMA’s website (http://www.ccma.org.za). Once this form has been properly filled out and the dispute has been located, it must be submitted to the opposite party via registered mail, fax, hand delivery, or email. Along with verification that the 7.11 form was sent to the opposite party, a second copy will also need to be submitted to the CCMA. The CCMA will set a date for the hearing once they have received your copy and evidence that the other party has also received their copy.
